Q: Does a driver need a CDL to operate a vehicle under 26,000 pounds gross vehicle weight rated?
A: No. A CDL is only required when driving vehicles with a gross vehicle weight rating of 26,001 or more pounds; any combined gross vehicle weight rating (2 units) 26,001 or more pounds; any vehicle that is required to be placarded, or carriers of 16 or more passengers including the driver.
Q: If a vehicle is under 26,000 pounds gross vehicle weight rated, but has air brakes, does the driver need a CDL?
A: No. Having air brakes is not a determining factor as to whether you are required to have a CDL (refer to first answer in this section).
Q: We have a driver with a CDL Learner's Permit. Do we have to have a complete Driver’s Qualification File on this driver?
A: Yes.
Q: If a driver is convicted of a DUI, how long will he loose his CDL?
A: For one year, for the first offense and forever for the second offense.
Q: How long do our drivers have once they move to another state to change their CDL?
A: 30 days.
Q: If my CDL with a Hazmat Endorsement expires and I go to the Motor Vehicle office to renew my CDL license,take my Hazmat Skills Test, but my Hazmat Endorsement Federal Security Threat Assesment hasn't come back yet, can I still operate a CMV?
A: Yes, you just can't haul Hazmat. You must return to the Motor Vehicle office once the HEFSTA comes in to get the Hazmat Endorsement added back on.
